An attempt by Tanathi Water Works Development Agency Board of Directors to impose embattled Francis Kyalo Siva who is highly tainted with corruption, has fallen flat after a court halted the flawed recruitment process.
Under the patronage of Siva’s relative, former Kilome MP Regina Ndambuki, who chairs the Board of Directors, the plan to impose him has been discreetly executed until a petitioner moved to court to challenge the process.
There are unverified reports emanating frim Tanathi that the Directors who interviewed the CEO job applicants were each given a bribe of Sh200,000, to ensure Siva is shortlisted.
The monies were allegedly brought in cash to the directors by two engineers identified as Mwango and Otieno, but the clandestine plan was leaked, and later confirmed by outcome of the shortlist.
The shortlist with his name shocked everyone including Tanathi staff as Siva is facing multiple scrutiny by law enforcement agencies including the Ethics and Anti-Corruption Commission and Directorate of Criminal Investigations.
Siva is used to conning his way to high office, with focus shifting to how he was employed as General manager for Infrastructure Development.
Recently, Siva was exposed by the Engineers Board of Kenya as a fake engineer lacking the legal and professional qualifications to hold not only his job position, but also the professional title.
Eng Margaret Ogai, the Registrar and CEO of Engineers Board ordered Mr Siva to immediately stop using the title “Engineer” before his names, because it violated statutory provisions as outlined in Section 47 and 49 of Engineers Act.
A spot check at Tanathi website revealed that both Siva and acting CEO Fidelis Kyengo have complied with EBK directive and removed the title Engineer before their names.
The alcohol addict known for loud weekend drinking escapades along Mombasa Road, and bullying junior staff to bulldoze corruption deals was employed without attaining a Masters degree, yet the General Manager post required such.
More trouble happened on Friday after a court in Kitui put brakes on the recruitment of a new Tanathi CEO over claims of impropriety and corruption.
Kitui Chief Magistrate David Mburu ordered the recruitment process, including interviews for shortlisted candidates scheduled for August 12th, be suspended until the case filed is heard and determined.
While issuing the ex-parte orders, Mr Mburu said he had considered the several grounds pointing to violation of the Constitution in the application filed by Mr Titus Isuza.
“The application is certified urgent, and that it should be served upon the respondents, and the matter be mentioned on August 7th for further directions” reads the orders issued by the magistrate.
In apparent reference to Siva, the petitioner alleges that some of the shortlisted candidates have serious integrity issues, and did not meet the required qualifications as outlined in the job advert and the Tanathi Agency’s Human Resource Policy and Career Guidelines.
This makes the recruitment process grossly flawed and unconstitutional.
The court case exposes Tanathi’s Board of Directors to scrutiny and questions their impartiality on the matter, Mr Isuza claims the shortlisted candidates were just cherry picked in clear violation of national values and principles of good governance on regional balance and gender inclusivity, transparency and accountability.
“The recruitment process was a sham, with a pre-determined outcome of shortlisted candidates, carefully calculated to benefit a particular candidate who is unfit for the job, against other well deserving job applicants” the suit papers read.
“Unless the court intervenes by way of injunction and to nullify the shortlist, a candidate with questionable integrity may be recruited to head Tanathi Water Agency and therefore undermine the principles upon which public institutions are established” reads the petitioner’s prayers to court.
The shortlist filed in court as part of the petition reveals that Siva, is among those shortlisted, despite the Engineers Board of Kenya questioning his suitability.
Other shortlisted candidates are Dennis Mulu, Joseph Ndiku, Mohammed Omar, Gilbert Biwott, John Musyoka, Sammy Naporos, Mohammed Abdikadir and Ismael Mohamuud.
